By accessing or using the MyExam.ng website, mobile applications, and related services (collectively, the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MyExam.ng.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Eligibility

By using the Service, you represent and warrant that:

• You are at least 13 years of age, or you have obtained parental or guardian consent
• You have the legal capacity to enter into these Terms
• You are not located in a country that is subject to a U.S. government embargo
• You will use the Service for lawful purposes only

3. User Accounts

3.1 Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time, with or without cause, and without prior notice. This includes but is not limited to violations of these Terms, illegal activities, or repeated infringement of intellectual property rights.

• Attempt to bypass any security measures or access restricted areas
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Share your account credentials with others

4.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Impersonating any person or entity, or falsely stating your affiliation
• Transmitting any viruses, malware, or other harmful code
• Harassing, threatening, or abusing other users
• Posting or sharing inappropriate, offensive, or objectionable content
• Using automated systems to access or interact with the Service

5. Content and Intellectual Property

5.1 Our Content

All content provided on the Service, including but not limited to text, graphics, logos, images, audio clips, video clips, software, and exam materials, is the property of MyExam.ng or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

By posting, submitting, or sharing content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of operating and improving the Service.

5.3 Copyright Policy

We respect the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of where the infringing material is located on the Service
• Your contact information (email address, phone number, and mailing address)
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on behalf of the owner

7. Subscriptions and Payments

7.1 Free Plan

MyExam.ng offers a Free Plan that provides access to limited features at no cost. The Free Plan includes a limited number of practice exams and basic analytics.

7.2 Premium Plan

The Premium Plan offers enhanced features, including unlimited exams, full analytics, video solutions, and priority support. By subscribing to the Premium Plan, you agree to pay the applicable subscription fees as described on our pricing page.

7.3 Payment Terms

• Subscription fees are charged on a recurring basis as selected (monthly or annually)
• Payments are processed through secure third-party payment processors
• All fees are non-refundable except as required by law
• We reserve the right to change subscription fees with 30 days' notice

7.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to Premium features until the end of your current billing cycle.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT PROVIDED ON THE SERVICE, INCLUDING EXAM MATERIALS AND ANALYTICS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYEXAM.NG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless MyExam.ng and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit or post on the Service

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Abia State, Nigeria.

13. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria, 2004.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and MyExam.ng regarding the Service and supersede all prior or contemporaneous communications.

14.2 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

14.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.4 Assignment

You may not assign these Terms or any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction.
